SECURING an AUTOMOBILE or TANGIBLE ITEM for
DISPLAY PROVIDING SERVICE
CONTRACT TERMS & CONDITIONS effective
Jan 1, 2018 (Read Carefully)
Hole-in-WON.com hereby agrees to provide the service to pursue and
potentially secure for display for the client named on this contract an
automobile or a tangible item up to a maximum specified prize at the
location, dates and time as specified within the contract in accordance
with a completed contest contract.
SUCH SERVICE SHALL BE SUBJECT to the FOLLOWING TERMS, CONDITIONS, ANY and
ALL ADDENDEMS, VARIABLE EVENT CONDITIONS, and ACCEPTANCE by a SIGNATURE,
STAMP or SEAL FROM a HOLE-in-WON.com MAIN OFFICE Official.
Client agrees that this is a contractual agreement between two parties,
Hole-in-WON.com & the Client to simply provide a display of a prize(s).
All terms and conditions are subject to change at the complete discretion

A. BEFORE PROVIDING the SERVICE
1. PAYMENT - A Valid and collectable event contest fee is the basis for
initiating and providing this Service. Envelope containing check for
Hole-in-WON.com Contest Contract(s), valid credit card or bank deposit
receipt into an account of Hole-in-WON.com must occur prior to the
initiation of the service. In the event that collected funds are NSF or
Bank Credit Card authorization clearance or any issue(s) occur, alternate
valid collectable payment, certified funds or bank wire will be forwarded
immediately to Hole-in-WON.com to cover such a determination, prior to the
providing or continuation of this service. (HOLE-in-WON.com WILL NOT BE
RESPONSIBLE FOR ANY PAYMENT VALIDATION SERVICE or SERVICE(S) and THIS
CONTRACT WILL TERMINATE IF VALID PAYMENT to HOLE-in-WON.com IS NOT
RECEIVED. Client or event is solely responsible for obtaining documentation
or proof of payment under this contract.
2. INCOMPLETE SERVICE - Client agrees that any incomplete service for the
delivery and proper display of an automobile or any tangible item either by
a 3rd party, the automobile dealership, tangible item company,
Hole-in-WON.com or otherwise does NOT render contest contract null &
void and client is still 100% liable for payments to Hole-in-WON.com and
the conditions set forth in this agreement and the ancillary contest
contract agreement.
B. DURING the PROVIDING of the SERVICE
3. CHANGES & CONFIRMATION of CHANGES - Except as set forth in the
Variable Tournament Conditions Section 4, Client will EMAIL or TEXT ONLY,
written confirmation of all communications from client of all valid agreed
upon changes and/or terms of this contract application and amendments. ONLY
a return email or text confirming, verifying a valid agreed upon change, by
a Hole-in-WON.com Office official, with Date & Time, texted or emailed
will suffice and supersede prior communications or changes of any term(s)
condition(s), and addendum(s). Confirmation of change(s) in term(s) as with
payment received to Hole-in-WON.com is the SOLE responsibility of client,
client assignee or event officials. Should Hole-in-WON.com, LLC, at their
determination, within reason, deny service by email, text, phone and/or
verbal notification to the client, sponsor, tournament director, or
otherwise a party involved with the event or an assignee is a Binding
Denial of the contracted prize display providing. NO EXCEPTIONS.
4. CLIENT FULLY UNDERSTANDS the RISKS, VARIABLES and HAPPENSTANCE /
UNKNOWNS ASSOCIATED with THIS AGREEMENT - Client accepts full
responsibility that many occurrences out of the control of Hole-in-WON.com
may occur at any moment and accepts the outcome. ( see section A2.) to
include but not limited to:
a.) Car Dealer or Tangible Item company changes mind for any reason.
b.) Car or Item has been sold or is not available in make model color $$
value.
c.) Company cannot provide the labor, personnel, insurance, transport
necessary to deliver or display the car or item.
d.) Golf Course or venue has location changes or restrictions on displaying
according to client requirements.
e.) Insurance or other requirements by any party not met.
f.) Witnesses and overseers not available at display or as required.
g.) Any incorrect banner, display signage, flyers, advertisements etc.
h.) Any conflict in scheduling, other commitments, rescheduled, postponed
and timing of delivery not met.
i.) Any other arrangement, deal amongst client, car dealer, tangible item
company, golf course, venue not coming to fruition.
j.) Hole-in-WON.com makes no claims of a 100% successful securement or
guarantees of delivery of an auto or tangible item should any of these
clauses not occur at any time.
C. VARIABLE EVENT CONDITIONS - INCLEMENT WEATHER - POSTPONEMENTS
5. VARIABLE GOLF - SPORTS - SPECIALTY EVENT CONDITIONS Specified Golf -
Sports Specialty Contest Event data pertaining to a change to, in regards
to any postponement(s) cancellation(s) or weather conditions require
written notification to Hole-in-WON.com via email or text the day of
postponement or cancellation and prior to the start of the event.
Rescheduling date MUST be done in writing and confirmed in writing by
Hole-in-WON.com PRIOR TO the start of the event. Email will suffice. No
partial or total refund will be given to client for events based on
variable events mentioned here in or in any correspondence for the
securement of an automobile or tangible item should a fee apply. Client
will pay an additional $150 fee for any continuation of securing an
automobile or tangible item for display on the rescheduled date or each
additional date. Any refund that is given will ONLY be put toward future
coverage of an event and at the complete discretion of Hole-in-WON.com NO
Exceptions.
